Implementation of Five-day Week Duty Pattern for the Midwives Council Secretariat
The Secretariat of the Midwives Council has moved to the five-day week duty pattern on 1 January 2007. The new opening hours of the Secretariat and its registration office are from 9:00 a.m. - 6:00 p.m. on Mondays and 9:00 a.m. - 5:45 p.m. from Tuesdays to Fridays, with meal break fixed at 1:00 p.m. - 2:00 p.m.. Other service arrangements, e.g. handling of registration applications and correspondences to the Midwives Council by mail, payment of registration fees and other related expenses, handling of enquiries and complaints, etc. remain unchanged and are provided during the above-mentioned new opening hours.

Preamble
The Midwives Council is formerly known as the Midwives Board. The Midwives Board was named when the Midwives Registration Ordinance was first enacted in 1910. The Midwives Registration (Amendment) Ordinance 1997 was introduced to re-name the Midwives Board as Midwives Council. The Midwives Council came into being on 30 September 1999.

Objective and Functions
The Midwives Council of Hong Kong (the Council) is a statutory authority established under the Midwives Registration Ordinance, Cap. 162 (the Ordinance). Its objective is to provide the community with midwives of the highest professional standard and conduct.
The main functions are as follows :
- To register any person satisfying the criteria for registration as a midwife and desiring such registration;
- To recognize courses of midwifery training for the purpose of registration under the Ordinance;
- To determine standards of examination for midwifery training under the Ordinance and to be responsible for the conduct of such examinations; and
- To carry out investigations of cases of alleged unprofessional conduct or unfitness to practise because of physical or mental illness.

Composition and Current Membership
The composition of the Council is stipulated in sections 3(2) and (3) of the Ordinance as follows :

a registered midwife in the public service of Hong Kong to be nominated by the Director of Health; |

a registered medical practitioner to be nominated by the University of Hong Kong; |
| (c) |
a registered medical practitioner to be nominated by The Chinese University of Hong Kong; |
| (d) |
a registered midwife to be nominated by the Hospital Authority within the meaning of the Hospital Authority Ordinance (Cap. 113); |
| (e) |
a registered midwife to be nominated by each hospital declared by the Council under regulations made under this Ordinance to be a training school for midwives; |
| (f) |
3 registered midwives nominated by the Hong Kong Midwives Association; |

Structure
The Council has an Education Committee, an Examination Sub-Committee, a Professional Development Committee, a Credential Vetting Panel, an Accreditation Committee and a Preliminary Investigation Committee to discharge its five basic functions and to formulate policies and strategies to cope with future developments of the midwifery profession.

Functions of Committees, Panel and Sub-committees
Accreditation Committee
- To assess, monitor and evaluate midwifery programmes proposed by midwives' training schools / institutes for the Council's consideration;
- To coordinate inspections to existing midwives' training schools/grounds and institutions applying for accreditation as midwives¡¦ training schools/grounds to ensure that the standard of midwifery education and training facilities comply with the requirements prescribed by the Council; and
- To make recommendations on applications for accreditation/re-accreditation of midwives¡¦ training schools/grounds, provider institutes for the Post-registration Education in Midwifery scheme and return-to-practice programmes for the Council's consideration.
Education Committee
- To make policy recommendations in respect of midwifery education and training;
- To organize and conduct the midwifery registration examination and make recommendations on the assessment methods;
- To assess, monitor and evaluate midwifery programs proposed by education institutions / training schools for the Council's consideration;
- To make recommendations on curriculum guidelines and implementation requirements;
- To co-ordinate regular visits to all existing and proposed midwifery education institutions to ensure the standard of midwifery education and training facilities comply with requirements prescribed by the Council.
Examination Sub-Committee
- To organize and conduct the midwifery registration examinations;
- To make recommendations on the assessment methods for the registration examinations;
- To set rules for examinations;
- To nominate chief examiners and examiners for the approval of the Council; and
- To keep under review the existing examination process, and to make recommendations to the Council for improvements when necessary.
Professional Development Committee
To advise the Midwives Council of Hong Kong on:-
- the delineation of the domain of midwifery practice;
- the code of professional conduct for midwives;
- the standard of professional practice;
- the development of continuing midwifery education; and
- the policies and strategies on the future developments of midwifery practice.
Credentials Vetting Panel
- To assess applications for registration and to recommend approval or refusal of these applications; and
- To recommend requirements, where applicable, regulating approval of registration.
Preliminary Investigation Committee (a statutory committee)
The Preliminary Investigation Committee (PIC) was established by the Council under section 12 of the Midwives (Registration and Disciplinary Procedure) Regulations, Cap. 162 to :
- make preliminary investigations of complaints or information touching on any matter that may be inquired into by the Council; and
- make recommendations to the Council for the holding of an inquiry under the Ordinance.

Midwifery Training in Hong Kong
At present, the only midwifery training programme approved by the Midwives Council of Hong Kong is the Hospital Authority 18-month Post-registration Diploma in Midwifery. The theoretical training of the programme is provided by the School of Midwifery of the Prince of Wales Hospital, while the clinical placement will be conducted in the maternity unit of various clinical training grounds approved by the Council. A person must be a registered nurse in Hong Kong in order to fulfill the entry requirement of the programme.

Registration Procedure
According to the Ordinance, any person who wishes to practise as a registered midwife in Hong Kong must be registered as a registered midwife with the Midwives Council of Hong Kong.
Registered midwives whose names have been removed from the register of midwives by the Midwives Council may apply for restoration of name to the register.
Applications for registration and applications for restoration of name to the register of midwives should be made on the prescribed application forms. Such forms and a Guide to Applicants are obtainable in person, or by a written request, or by fax on demand, from the Secretariat of the Council, or at the Central Registration Office, Boards and Councils Office on 17th floor, Wu Ching House, 213 Queen's Road East, Wan Chai, Hong Kong. The application form may also be downloaded from this homepage.

Completed application form, together with all related documents, may be returned in person, or by a representative of the applicant, or by post to the Secretariat of the Midwives Council.
The prescribed fees for issuing of Certificate of Registration is HK$305 for locally trained applicants and HK$1,000 for non-local trained applicants. The prescribed fees for restoration of name to the register of midwives is HK$145. Please note that no fees will be charged before approval of the application.
Secretariat counter service for application for registration is provided from 9:00 a.m. to 1:00 p.m., and from 2:00 p.m. to 5:00 p.m. from Mondays to Fridays, and 9:00 a.m. to 1:00 p.m. on Saturdays.

Registration Requirements
- An applicant trained outside Hong Kong should:
- have completed a training course compatible with that of Hong Kong;
- possess a valid certificate to practise midwifery, or other documentary evidence issued by such certifying body as may be recognized by the Council from time to time as evidence of their competency to practise midwifery; and
- have passed the Midwives Council Examination, and if required, to undergo such further training as the Council may specify.
- An applicant trained in Hong Kong should:
- have completed midwifery training in a recognized training institute; and
- have passed the Midwives Council Examination, and if required, to undergo such further training as the Council may specify.

Registration Examination
The Council will conduct the registration examination annually, and as and when required, taking into account the number of candidates. The next examination will be held in October 2008.
The Secretariat will inform all midwifery training schools about the details of the examination and invite entries two months prior to the examination.
For overseas trained midwives required to sit for examination, the Secretariat will inform them directly of the examination details.
The examination fee is HK$1,425.

Practising Certificate
A registered midwife cannot practise midwifery in Hong Kong unless she is a holder of a valid practising certificate issued by the Midwives Council.
A registered midwife may send the written application for the practising certificate to the Secretariat. The application for the practising certificate must be accompanied by a signed statement stating that the applicant has not been convicted of a criminal offence punishable with imprisonment. The fee for a practising certificate is HK$225. The holder of a current practising certificate may apply in writing to the Secretariat for a replacement copy if the original practising certificate is lost, destroyed or defaced. The fee for a replacement copy of a practising certificate is HK$185.
A practising certificate is valid for a period not exceeding 3 years and ending on 31 December. It should be renewed when expired. If you are a holder of a practising certificate which is due to expire, you will be informed to renew the certificate by the Secretariat.

Disciplinary Procedures
In accordance with the Midwives Registration Ordinance, Cap. 162, the Midwives Council deals with complaints against registered midwives touching on matters of professional misconduct. It has no jurisdiction over claims for refund or compensation, which should be pursued through separate civil proceedings.
Complaint against a registered midwife on her professional misconduct should be forwarded to the Secretariat in writing. The Secretariat will refer the complaints to the Chairman of the Council's Preliminary Investigation Committee (PIC) for consideration.
The PIC will decided whether to dismiss the complaint or refer it to the Midwives Council for inquiry. The Council, at the conclusion to the hearing, will decide whether to dismiss the complaint or to pass a sentence if the registered midwife is found guilty. She may then be punished in the form of a disciplinary order, ranging from the removal of her name from the register to reprimand her.
